Adaptation of Supplementary Terms from 1 October 2018

Hereby we inform you as a Balancing Group Manager pursuant to § 10 of the currently valid "Supplementary GASPOOL Balancing Services GmbH (GASPOOL) Terms of Business for Balancing Group Managers" (Supplementary Terms) in conjunction with § 30 (2) of the current "Balancing Group Contract Terms & Conditions" two months in advance on an amendment of the currently valid Supplementary Terms, which shall enter into force on October 01, 2018.

The amendment concerns the introduction of an entitlement of GASPOOL to require reasonable advance payments on balancing group manager’s expected Conversion Neutrality Charge in § 3 sentence 2 of the Supplementary Terms. In addition, an editorial change was made in § 3 sentence 2. The term “operating reserve levy” currently used there has now been replaced by the currently valid terms "SLP and RLM Balancing Neutrality Charges". All contractual data remain unaffected by the changes.

The amendment is based on § 10 of the currently applicable Supplementary Terms in conjunction with § 30 (2) of the current Balancing Group Contract Terms & Conditions. The Balancing Group Manager shall be deemed to have accepted the aforementioned amendment of the Supplementary Terms unless the Balancing Group Manager terminates this contract within 15 Business Days of being notified thereof with this message.

Adaptation of Balancing Group Contract Terms from 1 October 2018

The new Cooperation Agreement X, updated from several gas associations (BDEW, VKU and GEODE) will be implemented with effect from 1 October 2018. GASPOOL as market area operator is therefore going to amend the Balancing Group Contract Terms & Conditions in accordance with the changes introduced by the Cooperation Agreement X.

The amendment of the CA X also involves changes to the Balancing Group Contract Terms & Conditions. In addition, there are the following further adjustments:

  • § 14 (7): In determining the applicable Daily Imbalance Prices, the Market Area Manager shall in each case base its calculations on the relevant Weighted Average Price of Gas as published on the day M+10 Business Days.Any changes in the Weighted Average Price of Gas occurring after this date shall not be taken into account for the purpose of determining the Daily Imbalance Prices.

  • § 25 (12): Adjustments to the calculation of the contractual penalty in the case of Restricted Physical Exchange Trades. 

Additionally GASPOOL updated the Agreement on the Linking of Balancing Groups pursuant to Section 17(3) of the Balancing Group Contract Terms & Conditions.

According to § 31 (2) of the current Balancing Group Contract, the Market Area Manager is entitled to make changes to the terms and conditions. According to § 31 (2) the Market Area Manager  informs you as the balancing group manager about the changes two months before the changes take effect. All contractual data remain unaffected. The change of the terms and conditions of this contract shall be deemed as accepted by the balancing group manager, unless the latter terminates the change within 15 working days from receipt of the information.
